Registering as a data handler with the Office of the Data Protection Commissioner (ODPC) in Kenya is a straightforward process. This article provides a simplified guide to help you through the registration process on the ODPC’s online portal.
Step-by-Step Registration Guide
1. Getting Started
To begin, visit the data portal at https://dataportal.odpc.go.ke/. On the portal, click on “account” and then select “register as a data Handler.” If you are a first-time user, choose the “first time registering” option to proceed.
2. Providing Your Details
Next, you will be prompted to fill in your pre-registration details. You will need to specify whether you are a data controller or a data processor and indicate if you operate in the public or private sector. After this, you will be required to enter your basic details.
3. Data Collection Information
This step requires you to describe the personal data you collect and the purpose for its collection. If you handle sensitive personal data, you must declare it and provide details on the type of data and its purpose.
4. Data Residency and Safeguards
If your data is stored outside Kenya, you need to disclose this and list the countries where the data is transferred. You will also be asked to detail the safeguards your organization has in place to protect the data. The portal provides a list of common safeguards, but you can also add your own specific measures.
5. Financial and Employee Information
You will need to enter your organization’s turnover from the previous year and upload proof of the same. Additionally, you will be required to select the number of employees in your organization.
6. Submission and Payment
Before submitting, you must certify that all the information you have provided is accurate. After that, you can fill in your login information, confirm, and submit your application. Once you have logged in, you can generate an invoice for the registration fee by clicking “click here to pay.” You can then select your preferred payment method and print the invoice, which will contain payment instructions.
